This Acceptable Use Policy ("AUP", "Acceptable Use") sets out the terms that govern how our Tools Platform and Services are to be used appropriately and shall apply to all customers and end users. The use of our Tools Platform or Services constitutes your agreement to these terms of Acceptable Use.
In addition, this AUP outlines the rules for submitting comments and posts on the ZeusDB Blog and applies to all customers, end users, contributors and visitors. Any visit or submission of material to the Blog is made on the basis that you accept, agree to abide and be bound by, all the terms and conditions of this Policy.
If you do not agree to these terms of Acceptable Use, please do not use or continue to use our Blog, Tools Platform or Services.
Modification of Terms
We reserve the right to change or modify any of the terms contained in this Acceptable Use Policy at any time. Following any changes we will revise the 'Last Updated' date at the top of this page. You acknowledge and agree that it is your responsibility to review the Website and these terms regularly. Your continued use of our Blog, Tools Platform or Services after such modifications to this AUP will constitute acknowledgment of the modified Acceptable Use and agreement to abide and be bound by the modified Acceptable Use Policy.
Use of ZeusDB Tools Platform and Services
Customers agree to use the ZeusDB Tools Platform and our Services in a manner that is appropriate, ethical and legal. Customers agree not to allow third parties or their end users to access or use our Tools Platform or Services for inappropriate, unethical or illegal purposes. Specifically, Customers agree to abide by the following requirements that govern the use of various components of our Tools Platform and Services as described below:
i. Sending unsolicited email messages: - ZeusDB strictly prohibits any involvement in the origination, generation or transmission of unsolicited email messages known as SPAM. All customers and end users must comply with the rules outlaid in the CAN-SPAM Act. This includes (but is not limited to): No false or misleading headers, relevant subject lines, advertisement disclosure messages and opt-out instructions.
ii. Uploading, storing, writing or any activity relating to the distribution of potential harmful software (including but not limited to) viruses, worms, phishing and malware is strictly prohibited.
iii. The transmission, storage or distribution of material that violates any law or regulation is strictly prohibited. This can include (but not limited to) the violation of intellectual property, copyright or trademarks without proper authorization from the owner or controlling entity, publication of defamatory or libellous information, or content that in any way exploits minors.
iv. To deliberately interfere, modify, disrupt or monitor our services, software or hardware for any purposes is strictly forbidden.
All ZeusDB customers and their affiliates or customers who use our Tools Platform or Services are expected to agree and adhere to all the terms aforementioned. ZeusDB customers agree to indemnify and hold harmless ZeusDB from any claims relating from the use of our Tools Platform or Services which damages the customer or any other party.
Use of ZeusDB Blog
The ZeusDB Blog is an online environment that allows people to share information and opinions with each other on a variety of topics. To ensure the integrity, safety, appropriateness, legality and quality of our blog, all users must comply with this Acceptable Use Policy. Specifically, any access or use of the Blog is subject to your compliance with the following rules of conduct. By using the forum in any way you specifically agree to comply with the following:
i. You will not post any copyrighted material unless you own or control the copyright to such material or have permission from the copyright owner to post the material.
ii. You will not use the Blog to post or transmit messages, comments or material that violates or infringes on the rights of another party, including, without limitation, rights of privacy, rights of publicity, copyright, trademark, or any other intellectual property rights.
iii. You will not post any messages, comments or material that is: abusive, hateful, racist, bigoted, sexist, harassing, threatening, inflammatory, defamatory, knowingly false, vulgar, obscene, sexually-orientated, and profane or is in violation of any applicable law, rule or regulation.
iv. You will not use this Blog to post material or comments for commercial purposes, including, without limitation posting advertisements or solicitations.
v. You will not post or transmit software, files or code that contains or can be used for purposes such as viruses, worms, malware or any other disruptive or harmful components or software.
vi. You agree that you are responsible for your own use of the Blog and for any material, posts or comments you make and ZeusDB are not responsible in any way for the content or opinions expressed therein. ZeusDB has the right, but not the obligation to remove, edit or move at any time, any material posted to the Blog, in each case as we deem appropriate.
vii. You agree that any reliance on material or comments posted on the Blog will be at your own risk. ZeusDB does not endorse, support, represent or guarantee the truthfulness, accuracy, or reliability of any material or comments posted on the Blog.
viii. You agree that by submitting, posting or commenting on our Blog you grant ZeusDB a worldwide, non-exclusive, royalty-free license to reproduce, publish, modify, copy, sublicense, adapt, transmit and distribute the content without limitation.
ix. You agree not to reproduce, duplicate, copy, sell, trade, resell, or exploit for any commercial purposes any material, posts or comments contained within the Blog unless expressly authorized in writing by ZeusDB.
x. You agree to hold harmless and indemnify ZeusDB and its subsidiaries, affiliates, officers, agents and employees from and against any claim arising from or in any way related to the use of our Blog, including any liability arising from claims, losses, damages, suits, judgements, litigation costs and attorney’s fees of every kind.
